These Terms of Service ("Terms") form a binding agreement between you and PokerUrMemory ("PokerUrMemory," "we," "us," or "our") and govern your use of our memory-training card game, including our website at pokerurmemory.com, our browser-based game, and our iOS and Android applications (together, the "Service").
Please also review our Privacy Policy, which explains how we handle your information and is incorporated into these Terms by reference.
1. Acceptance of terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, which may be higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you are not barred from using the Service under any applicable law.
3. The Service and our no-gambling commitment
PokerUrMemory is a brain-training strategy game inspired by 5-card draw poker. It is designed to challenge and exercise visual memory, working memory, attention, and strategic thinking in an entertaining format.
PokerUrMemory is not a gambling product. There is no real-money wagering, no betting with currency, no purchasing of chances to win money or prizes, and no cash payouts of any kind. Any points, chips, or scores in the game have no monetary value, cannot be redeemed for real money or anything of value outside the game, and exist solely for entertainment and to track progress and skill.
We may update, modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
4. Accounts
Some features may require you to create an account or sign in. If you create an account, you agree to:
- Provide accurate and current information.
- Keep your login credentials confidential and secure.
- Be responsible for all activity that occurs under your account.
- Notify us promptly of any unauthorized use of your account.
You may not share your account, use another person's account without permission, or create an account using false information. We reserve the right to reclaim usernames or suspend accounts that violate these Terms.
5. License to use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your own personal, non-commercial entertainment. This license does not grant you any ownership rights in the Service.
6. Acceptable use
When using the Service, you agree that you will not:
- Violate any applicable law, regulation, or third-party right.
- Cheat, exploit bugs, use bots or automation, or otherwise interfere with fair play.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service, except where permitted by law.
- Copy, modify, distribute, sell, or lease any part of the Service or its content without our permission.
- Upload or transmit viruses, malware, or any code designed to disrupt or damage the Service.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Harass, abuse, threaten, impersonate, or harm other users, or post content that is unlawful, hateful, obscene, or otherwise objectionable.
- Use the Service to send spam or unsolicited communications, or for any commercial purpose without our prior written consent.
We may investigate and take appropriate action, including removing content, suspending or terminating accounts, and reporting to law enforcement, against anyone who violates this section.
7. User content
You may have the opportunity to submit content, such as a username, profile details, messages, or feedback ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, use, display, and reproduce that content as necessary to operate and improve the Service.
You are solely responsible for your User Content and represent that you have the rights to submit it and that it does not violate these Terms or any law. We may remove User Content that we believe violates these Terms or is otherwise objectionable, at our discretion.
8. Intellectual property
The Service and all of its content—including software, code, graphics, card designs, logos, text, sounds, and the "PokerUrMemory" name and branding—are owned by PokerUrMemory or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted above, nothing in these Terms transfers any intellectual property rights to you.
You may not use our trademarks, logos, or branding without our prior written permission.
9. Virtual items and purchases
The Service may offer optional, non-essential digital items or features. Where in-app purchases are available, they are processed by the relevant app store (Apple or Google), subject to that store's terms and payment policies. We do not collect or store your payment card details.
Any virtual items, points, or chips are licensed to you, not sold, and have no real-world monetary value. They cannot be redeemed for cash, traded for anything of value outside the game, or transferred. Purchases are final except as required by applicable law or the relevant app store's refund policy.
10. App store terms
If you download our app from the Apple App Store or Google Play, your use is also subject to that platform's terms. For the Apple App Store, you acknowledge that:
- These Terms are between you and PokerUrMemory only, not with Apple.
- Apple has no obligation to provide maintenance or support for the app, and is not responsible for any product warranties or claims relating to the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Similar terms apply to Google Play. You agree to comply with all applicable third-party terms when using the app.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
Cognitive and health disclaimer. PokerUrMemory is intended for entertainment and mental exercise. While it is designed to provide structured practice in memory and attention, we make no medical claims and do not guarantee any particular improvement in memory, cognition, or any health outcome. The Service is not a medical device and is not a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your cognitive health, please consult a qualified professional.
12. Limitation of liability
To the maximum extent permitted by law, in no event will PokerUrMemory, its affiliates, officers, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
To the maximum extent permitted by law, our total aggregate liability for any claims relating to the Service will not exceed the greater of (a) the amount you paid us, if any, in the twelve months before the claim arose, or (b) USD $50. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless PokerUrMemory and its affiliates, officers, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any applicable law or third-party right.
14. Termination
You may stop using the Service at any time and may delete your account where that option is available. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service.
Upon termination, the licenses granted to you will end. Sections that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, indemnification, and governing law—will continue to apply.
15. Governing law and dispute resolution
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-laws principles. You agree to first attempt to resolve any dispute with us informally by contacting legal@pokerurmemory.com. If a dispute cannot be resolved informally, it will be resolved in the courts of competent jurisdiction, subject to any mandatory consumer protections available to you under local law.
Nothing in these Terms limits any statutory rights you may have as a consumer that cannot be lawfully waived.
16. Changes to these terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
